1. Collection of Information
1.1 Survey Information. On the websites, the Company collects information from individuals when an individual fills out a form and/or any other surveys on the websites; collectively, the “Surveys”. In the surveys, the Company asks an individual to provide his or her name, street address, telephone number, zip code, birth date, gender, email addresses, and other information from time to time. Completing the surveys is completely voluntary. The Company hereby informs visitors to its websites that it will use the information collected in the surveys to target advertising to the interests of the individuals and that the Company may sell or transfer the information to third parties. Individuals are under no obligation to provide survey information, but they will not be able to use all the features of the websites without providing survey information.
1.2 Other Information. In addition to the surveys, the other occasions when the Company requests personal information are (1) when an individual requests assistance through our customer service department, and (2) when an individual voluntarily subscribes to our newsletter (together, “Other Information”).
1.3 Cookie Information. The Company uses cookie technology to associate an individual’s computer and/or mobile device with information about the individual in our database (“Cookie Information”). A cookie is a small amount of data that is sent from Company servers to an individual’s browser and stored on the hard drive of the individual’s computer or on an individual’s mobile device. Visitors need to accept cookies to use all of the features and functionality of the websites.
1.4 Outside Information. The Company may also receive information about users from third parties (“Outside Information”). The Company may add such Outside Information to its existing User Information, to better target our advertising and to provide pertinent offers in which we think you would be interested. To enrich our database of individual customers, we tie this information to the personally identifiable User Information you have provided to us.
1.5 No Information Collected from Children. Consistent with the Federal Children’s Online Privacy Protection Act of 1998 (COPPA), the Company will never knowingly request personally identifiable information from anyone under the age of 13. Because it does not collect such information, the Company has no such information to use nor to disclose to third parties.
1.6 User Information. As used herein, User Information means Survey Information, Other Information, Cookie Information, Outside Information and any other information the Company gathers or receives about users, such as, but not limited to: name, address, telephone number, email address, credit card or financial account information and demographic information (such as income level and gender) to process your submission.
1.7 Browsing BuyCenturyLink.com. This website does not collect personally identifiable information from your computer when you browse this website and request pages from our servers. This means that, unless you voluntarily and knowingly provide us with personally identifiable information, we will not know your name, your email address, or any other personally identifiable information. The Company’s servers automatically record non-personally identifiable information when you visit our website or use some of our products. When you request a page from our website, our servers log the information provided in the HTTP request header including the IP number, the date and time of the request, the URL of your request, the language used, the browser type and any other information that is provided in the HTTP header. We collect the HTTP request header information in order to make our website function correctly and provide you the functionality that you see on this website. We also use this information to better understand how visitors use our website and how we can better tune it, its contents and functionality to meet your needs.
2. Use of User Information
2.1 Discretion to Use Information. The Company may use the User Information for any legally permissible purpose at the Company’s sole discretion. The following paragraphs in Section 2 describe how the Company currently uses the User Information, but the Company may change or broaden its use at any time. As noted below, the Company may update this policy from time to time. The Company may make use of User Information for telemarketing, direct mail marketing, email advertising, targeted online banner advertising and package stuffers, among other possible uses.
2.2 Targeted Advertising. Based on the User Information, the Company attempts to customize and target advertising to an individual. The Company may, at its discretion, target advertising in email and direct mail. Due to the infancy of this technology, users should not expect to see immediate changes in the types of targeted advertising they see.
2.3 Email. The Company uses User Information to provide email marketing materials to users. The Company may maintain separate email lists for different purposes. If email recipients wish to end their email subscription from a particular list, they need to follow the instructions at the end of each email message to unsubscribe from the particular list.
2.4 Direct Mail and Telemarketing. The Company uses User Information to advertise, directly or indirectly, to individuals over the telephone and using postal mail.
2.6 Profiles of Users. The Company uses User Information to make a profile of users of the site. A profile is created by associating the various sources of User Information.
3. Dissemination of User Information
3.1 Sale to Third Parties. The Company may sell or transfer User Information to non-affiliated third parties for the purposes of sending you offers of goods or services via email, postal mail and telemarketing promotions. We prohibit the sale or transfer of personal information to non-affiliated entities for their use without giving you the opportunity to opt-out. (See Your Choices/Opt-Out Below). We may share your personally identifiable information with affiliated companies that are directly or indirectly controlled by, or under common control of the Company. We may send personally identifiable information about you to non-affiliated companies that are not directly or indirectly controlled by, or under common control of, the Company.
3.2 Transfer to Third Parties. User Information to third parties when necessary to provide a product or service that a user orders from such third parties while using our sites.
3.3 Legal Disclaimer. The Company reserves the right to disclose your personally identifiable User Information, as required, to comply with the law, applicable regulations, governmental and quasi-governmental requests, judicial proceedings, court orders or subpoenas, to enforce our Legal Notices or other agreements, or to protect our rights, property or safety or the rights, or to protect the property or safety of our users or others (e.g., to a consumer reporting agency for fraud protection etc.), and to ensure the security of our network and services.
3.4 Summary (Aggregate) Data. The Company may also share summary or aggregated information that does not identify you, the consumer, with outside companies. “Aggregated Information” refers to information the Company gathers by aggregating non-personally identifiable information to provide summaries of use of the website. The aggregated information is used to show usage patterns and to do such things as negotiate with vendors of Internet services. Such information is not linked to personal User Information.
4. Privacy Practices of Third Parties
4.1 Advertiser cookies. Advertising agencies, advertising networks, and other companies (together, “Advertisers”) who place advertisements on our sites may set their own cookies on your computer and collect information from such cookies. The Company does not control the Advertisers use of their own cookies and the Company disclaims any responsibility for such cookies and the use of information gathered from them.
4.3 Disclosure of Information in chat rooms or other areas of our websites. Users should be aware that if they disclose personally identifiable information (for example, their name, address, telephone number, or email address) in chat rooms or other areas of our web sites, that information can be collected and used by third parties and may result in unsolicited messages from third parties, among other things. Such activities are beyond the control of the Company, and we recommend that individuals use caution when disclosing personal information.
4.4 Affiliated Companies. The Company may disclose, transfer and sell User Information to entities affiliated with the Company at the Company’s sole discretion.
4.5 Third Party Advertisers. Any ads appearing on this website are delivered to users by our advertising partner. We share website usage information about users with a reputable third party for the purpose of targeting our Internet banner advertisements on this site. The information collected and shared through this technology is not personally identifiable.
5. “Do Not Call” Policy
If a consumer requests a copy of this “Do Not Call” policy we will send a copy via U.S. mail. Consumers may request, by telephone or in writing, that our company stop calling them and place their name on a Do Not Call list. Although we may ask for your name, address and telephone number, we will accept your request even if you only provide your telephone number. You have a right to have calls stopped and be put on our Do Not Call list even if you are still a customer. When we receive your request, your telephone number is added to our Do Not Call list immediately (if received through the mail, on the next business day, if requested over the phone, your number will be added in real time). In some cases it may take up to one week for your telephone number to be removed from companywide calling lists. Your request will stay on our list for at least 5 years. If you move, change your telephone number, or add an additional telephone number, you must provide us with the new telephone number in order for us to prevent calls to that number. We will not share the information you provide with anyone except affiliated companies or subsidiaries without your prior written permission. All employees that engage in outbound telephone solicitation are trained in this policy and made aware of these procedures before they are allowed to place calls to consumers. Managers, supervisors, or trainers review the policy with these employees annually. If a consumer notifies us that they have received a telephone call from us after they already requested to be placed on our Do Not Call list, we will apologize for the intrusion and have a manager or supervisor investigate. The manager or supervisor will also personally confirm that the telephone number is on the Do Not Call list. Upon request, we will mail the consumer a confirmation that their telephone number is on the list. Telephone requests can be made by calling 1.866.659.3474 and selecting Option 2. It may take several weeks before you notice a reduction in calls.
